Agreement to Terms

By accessing or using thoughtfully.cards, you agree to these Terms of Service. If you do not agree, please do not use our service.

Description of Service

thoughtfully.cards is an AI-assisted greeting card service operated by FishJump, Inc. that helps you send physical greeting cards for birthdays, anniversaries, and other occasions. We:

  • Store your contacts and their important dates
  • Notify you when occasions are approaching
  • Generate personalized card messages using AI
  • Print and mail physical cards through our fulfillment partner

Account Registration

To use thoughtfully.cards, you must:

  • Sign in with a valid Google account
  • Provide accurate contact information
  • Be at least 18 years old or have parental consent
  • Keep your account credentials secure

You are responsible for all activity under your account.

User Content and Acceptable Use

Your Responsibility

You are solely responsible for the content of messages you send through our service, including any text you write or AI-generated suggestions you approve. We do not pre-screen or monitor the content of your cards.

Prohibited Content

You agree not to send cards containing:

  • Threats, harassment, or intimidation
  • Defamatory or libelous statements
  • Obscene or sexually explicit material
  • Content that violates any law

Recipient Complaints

If we receive a complaint from a card recipient regarding content you sent, we will:

  • Review the complaint and the card content
  • Contact you regarding the complaint
  • At our discretion, suspend or permanently cancel your account

We take recipient complaints seriously. Accounts associated with harassment, threats, or other harmful content will be terminated.

Other Prohibited Uses

You also agree not to:

  • Use our service for any illegal purpose
  • Impersonate others or misrepresent your identity
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt our service
  • Use automated means to access our service without permission

We reserve the right to suspend or terminate accounts that violate these terms.

Payments and Refunds

Pricing

  • Card prices are displayed before purchase and include printing, postage, and handling
  • Prices may change; you will always see the current price before completing a purchase

Payment Processing

  • Payments are processed securely by Stripe
  • We accept major credit and debit cards

Refunds

  • Before printing: Full refund available if you cancel before the card enters production
  • Production errors: Full refund or reprint if we make an error (wrong address, printing defect)
  • Delivery issues: We will work with you to resolve undelivered cards
  • No refund: Once a card is successfully printed and mailed, we cannot offer refunds for change of mind

AI-Generated Content

Our service uses artificial intelligence to suggest card messages. You should:

  • Review all AI-generated messages before sending
  • Edit messages as needed to reflect your personal voice
  • Understand that AI suggestions are starting points, not final content

You are responsible for reviewing and approving all content before cards are sent.

Intellectual Property

  • FishJump, Inc.'s logos, designs, and software are our property
  • Card designs are licensed from our fulfillment partners
  • You retain ownership of your contact data and custom messages

Limitation of Liability

To the maximum extent permitted by law:

  • Our service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the 12 months before the claim
  • We are not responsible for delays or failures caused by postal services, fulfillment partners, or circumstances beyond our control

Indemnification

You agree to indemnify and hold harmless FishJump, Inc. from claims arising from your use of the service, your violation of these terms, content you send through our service, or your violation of any rights of another.

Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes will be resolved in the courts of Massachusetts.

Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance.

Termination

  • You may close your account at any time
  • We may suspend or terminate your account for violation of these terms or in response to recipient complaints
  • Upon termination, your right to use the service ends immediately
